{"id":58989,"date":"2023-04-28T10:44:28","date_gmt":"2023-04-28T14:44:28","guid":{"rendered":"https:\/\/montreal-west.ca\/?p=58989"},"modified":"2023-05-02T15:06:33","modified_gmt":"2023-05-02T19:06:33","slug":"amendment-to-the-loan-by-law-procedure","status":"publish","type":"post","link":"https:\/\/montreal-ouest.ca\/en\/amendment-to-the-loan-by-law-procedure\/","title":{"rendered":"Amendment to Loan By-law 2023-001 : procedure"},"content":{"rendered":"\n<p>At the special Council meeting held on April 27, 2023, Town Council adopted <a href=\"https:\/\/montreal-west.ca\/wp-content\/uploads\/2023\/05\/01-2023-003-reglement-amendant-emprunt-2032-001.pdf.pdf\"><em>By-Law No. 2023-003 \u2013 By-Law Amending By-Law No. 2023-001 Ordering the Construction of a new Sports and Recreation Centre to Increase the Expenditure and Authorized Loan by an Additional Amount of $6,686,024<\/em><\/a>.<\/p>\n<h3>Registration day and referendum<\/h3>\n<p><strong>Residents opposed to the loan by-law<\/strong> may sign a register to hold a referendum to approve or reject the by-law.<\/p>\n<p>Registration will take place <strong>on Friday, May 5, 2023 from 9 a.m. to 7 p.m. in the Music Room at Town Hall. <\/strong><\/p>\n<p>The persons qualified to vote must ascertain their identity by presenting one of the following documents:<\/p>\n<ul>\n<li>health insurance card<\/li>\n<li>driver&#8217;s license<\/li>\n<li>passport<\/li>\n<li>certificate of Indian status or<\/li>\n<li>membership card of Canadian Forces.<\/li>\n<\/ul>\n<p>Additional details about the conditions to be recognized as a person qualified to vote may be found in the <a href=\"https:\/\/montreal-west.ca\/wp-content\/uploads\/2023\/04\/2023-04-28-Public-notice-Register-By-Law-2023-003.pdf\">public notice<\/a> that was published on April 28, 2023.<\/p>\n<p>The A<em>ct respecting elections and referendums in municipalities,<\/em> sets out the rules for identifying who is eligible to vote. The calculation formula set out in the Act also determines the number of signatories required to hold a referendum. In the case of Montreal West, this number is 391.<\/p>\n<p><strong>There are two possible scenarios following registration day:<\/strong><\/p>\n<p><strong>A) If the minimum number of 391 opponents as required by law is reached<\/strong>, a referendum vote to approve or reject the loan by-law will be held in June, according to the legislated timelines.<\/p>\n<p><em>Following the referendum vote, if the majority votes &#8220;No&#8221;, the project will not proceed. If the majority votes &#8220;Yes&#8221;, the project will go ahead <\/em><strong><em>without a second vote.<\/em><\/strong><\/p>\n<p><strong>B) If the minimum number of 391 signatures as required by law is not reached, <\/strong>the file will be sent to the Minist\u00e8re des affaires municipales et de l&#8217;habitation (MAMH) for approval of the loan by-law and a vote will be held.<\/p>\n<p>Regardless whether we move forward with a referendum or a vote, there will be two voting days that will be announced in due course.<\/p>\n<h3>New Sports and Recreation Center FAQ<\/h3>\n<p>The Town has received many questions from residents concerning the new Sports and Recreation Center project.
